dc.description	The qualification paper examines the legal and organizational aspects of developing technical land management documentation for establishing the boundaries of a part of a land plot to which an easement right applies. The importance of a land easement as a limited real right is substantiated, as it provides the possibility of using another person’s land plot or part of it without terminating the ownership right to that land plot. The paper analyzes the essence, features and types of land easements and defines their place in the system of land legal relations. The regulatory and legal framework for establishing the boundaries of a part of a land plot subject to an easement is studied in accordance with the provisions of Ukrainian land, civil, cadastral and registration legislation. Particular attention is paid to the content of technical land management documentation, the role of the cadastral plan, and the determination of the coordinates, area and configuration of the part of the land plot that is the object of easement use. Based on the analysis of the practical aspects of developing technical documentation, the procedure for preparing initial data, establishing the boundaries of a part of a land plot, preparing textual and graphic materials, as well as entering the relevant information into the State Land Cadastre and carrying out state registration of the real easement right, is characterized. Foreign experience in establishing land easements is summarized, a comparative characterization of Ukrainian and foreign practice is carried out, and directions for improving the procedure for formalizing easement rights are identified. The practical significance of the paper lies in the possibility of using its results in the development of technical land management documentation for establishing the boundaries of a part of a land plot subject to an easement, improving land management practice, ensuring the accuracy of cadastral information, and preventing land disputes between land plot owners and persons in whose interests an easement is established.	uk_UA
dc.description.abstract	У кваліфікаційній роботі досліджено правові та організаційні аспекти розроблення технічної документації із землеустрою щодо встановлення меж частини земельної ділянки, на яку поширюється право сервітуту. Обґрунтовано значення земельного сервітуту як обмеженого речового права, що забезпечує можливість користування чужою земельною ділянкою або її частиною без припинення права власності на неї. У роботі проаналізовано сутність, ознаки та види земельних сервітутів, визначено їх місце в системі земельних правовідносин. Досліджено нормативно-правове регулювання встановлення меж частини земельної ділянки з правом сервітуту відповідно до положень земельного, цивільного, кадастрового та реєстраційного законодавства України. Окрему увагу приділено змісту технічної документації із землеустрою, ролі кадастрового плану, визначенню координат, площі та конфігурації частини земельної ділянки, що є об’єктом сервітутного користування. На основі аналізу практичних аспектів розроблення технічної документації охарактеризовано порядок підготовки вихідних даних, встановлення меж частини земельної ділянки, формування текстових і графічних матеріалів, а також внесення відповідних відомостей до Державного земельного кадастру та державної реєстрації речового права сервітуту. Узагальнено зарубіжний досвід встановлення земельних сервітутів, здійснено порівняльну характеристику української та зарубіжної практики, визначено напрями вдосконалення процедури оформлення сервітутних прав. Практичне значення роботи полягає у можливості використання її результатів під час розроблення технічної документації із землеустрою щодо встановлення меж частини земельної ділянки з правом сервітуту, удосконалення землевпорядної практики, забезпечення точності кадастрових відомостей та запобігання земельним спорам між власниками земельних ділянок і особами, в інтересах яких встановлюється сервітут.	uk_UA
