Abstract:
Цивільно-процесуальні норми, пов’язані із наказним провадженням, перебувають у відповідності з міжнародним законодавством і повністю відповідають його стандартам. Не зважаючи на це, часто виникають питання, пов’язані із процесом доказування в наказовому провадженні, а також щодо засад змагальності, реалізації права на захист кожним із учасників провадження, особливо якщо це стосується порядку оскарження ухваленого судового наказу.

The civil procedural rules related to injunctive proceedings are in accordance with international law and fully meet its standards. In spite of this, questions often arise related to the process of proof in injunctive proceedings, as well as the principles of competition, the exercise of the right to defense by each of the participants in the proceedings, especially if it concerns the procedure for appealing an adopted court order.
