Стаття присвячена комплексному аналізу трансформації інституту спадкування в Україні під час дії правового режиму воєнного стану, виявленню нормативних колізій у чинному законодавстві та розробці практичних і теоретичних рекомендацій щодо вдосконалення механізмів реалізації спадкових прав. Особливої уваги приділено проблематиці забезпечення права військовослужбовців на розпорядження майном на випадок смерті безпосередньо в складних умовах бойових дій.
Суть розробки, основні результати:
The article is devoted to a comprehensive analysis of the transformation of the inheritance institution in Ukraine during the legal regime of martial law, the identification of normative collisions in current legislation, and the development of practical and theoretical recommendations for improving the mechanisms for realizing inheritance rights. Special attention is paid to the problem of ensuring the right of military personnel to dispose of property in the event of death directly in the difficult conditions of combat operations.
