It is established that the legal regulation of the sphere of land relations, including by the norms of criminal law, is a special prerogative for the legislation of Ukraine, since land is not merely a natural resource, but a strategically important economic and environmental resource, as well as an element of national security of our state. Under the conditions of the legal regime of martial law, our state does not abandon its pro-European course of development and effectively implements sustainable development goals. However, with each year of the war's escalation on the territory of Ukraine, devastating damage has been inflicted on the environmental state of natural resources – air, water, and the land fund. A part of the land fund is no longer under the control of Ukraine due to occupation, while the controlled territories are subjected to destruction and catastrophic pollution. Nowadays, when humanity is in search of effective ways to preserve natural resources for present and future generations, the total destruction of Ukraine's fertile soils, which are so valuable to the entire world, looks like a crime against humanity. The whole world is already beginning to gradually experience the consequences of this pernicious impact.
Furthermore, it is established that Ukraine is not free from internal obstacles regarding criminal liability for offenses in the sphere of land relations: such as the criminalization of acts in emerging relations; the systematization of the norms of the current Criminal Code of Ukraine; and a low level of education and awareness of the population regarding their land rights. The issues of the invertigability of criminal offenses in the sphere of land relations and bringing guilty persons to liability, along with the imperfection of the system of proof and investigation, lead to an annual increase in crime with a meager number of indictments issued by courts.
