Abstract:

У статті автори досліджують право на освіту в системі прав людини, генезу права на освіту. Автори розглядають право на освіту, як суб’єктивне та комплексне право, яке належить до соціальних, економічних, культурних та інформаційних прав людини «другого покоління», тобто, воно було ідентифіковане та сформоване пізніше за право на життя, право на гідність особи чи право на свободу та особисту недоторканність, хоча становлення права на освіту пройшло кілька етапів, які обумовлені змінами в суспільстві, політиці та економіці. Культурний аспект права на освіту полягає в тому, що культурні права гарантують духовний розвиток людини, допомагають кожному індивіду стати корисним учасником політичного, духовного, соціального й культурного прогресу. Соціальний аспект полягає в питанні про платність або безоп¬латність його отримання, в наданні державою соціальних гарантій його отримання. Економічний аспект − у тому, що його реалізація є найваж-ливішим чинником науково-технічного й економічного зростання держави, яке може бути забезпечене лише високоосвіченими громадянами. Інформаційний аспект стосується доступу до інформації, яка необхідна для реалізації цього права. Окрім того, стаття також висвітлює генезу права на освіту. Право на освіту має довгу історію та починає формуватися в стародавніх цивілізаціях. На цьому етапі термін «право на освіту» не вживалося, а освіта ототожнювалася з вихованням, проте у працях філософів спостерігаємо потребу в знаннях та самовдосконаленні. В Середньовіччі освіта мала релігійне забарвлення, а освіта та культура розумілися взаємопов’язаними поняттями. Період Просвітництва в Європі (XVII-XVIII століття) став переломним моментом у розвитку ідеї права на освіту. Значний внесок у розвиток теорії прав і свобод людини зробили відомі філософи, такі як Ж.-Ж. Руссо, Дж. Локк, Вольтер, Д. Дідро, які виступали за доступність освіти для всіх, незалежно від соціального статусу. Освіта почала розглядатися як засіб підвищення рівня знань, моральності та громадянської відповідальності, а мета освіти – це виховання вільної людини. XIX століття характеризується поширенням ідеї рівного доступу до освіти для всіх громадян, незалежно від статі, раси або соціального статусу. XX століття стало періодом міжнародного визнання права на освіту як фундаментального права людини.

Article deals with the right to education in the system of human rights, the genesis of the right to education. The authors consider the right to education as a subjective and complex right, which belongs to the social, economic, cultural and informational rights of “second generation”. That means, it was identified and formed later than the right to life, the right to person dignity, or the right to freedom and inviolability of the person, although the formation of the right to education has gone through several stages, which are caused by changes in society, politics and the economy. The cultural aspect of the right to education is that cultural rights guarantee the spiritual development of a person, help each individual to become a useful participant in political, spiritual, social and cultural progress. The social aspect consists in the question of whether it is paid or free of charge, in the state’s provision of social guarantees for its receipt. The economic aspect is that its implementation is the most important factor in the scientific, technical and economic growth of the state, which can only be ensured by highly educated citizens. The informational aspect refers to access to information that is necessary for the implementation of the right. In addition, the article also highlights the genesis of the right to education. The right to education has a long history and begins to take shape in ancient civilizations. At this stage, the term “right to education” was not used, and education was equated with upbringing, however, in the works of philosophers, we observe the need for knowledge and self-improvement. In the Middle Ages, education had a religious colour, and education and culture were understood as interconnected concepts. The Enlightenment period in Europe (XVII-XVIII centuries) was a turning point in the development of the idea of the right to education. Famous philosophers made a significant contribution to the development of the theory of human rights and freedoms. J. J. Rousseau, J. Locke, Voltaire, D. Diderot were among them. They advocated the availability of education for everyone, regardless of social status. Education began to be considered as a means of increasing the level of knowledge, morality and civil responsibility. The goal of education was the education of a free person. The 19th century was characterized by the spread of the idea of equal access to education for all citizens, regardless of gender, race or social status. The 20th century became the period of international recognition of the right to education as a fundamental human right.
